Do You Need Residency to Buy Property in Costa Rica?

One of the most common questions from foreigners interested in Costa Rica real estate is: Do I need residency to buy property in Costa Rica?
The short answer is no.
Foreigners can generally purchase and own titled property in Costa Rica without being Costa Rican citizens or legal residents.
Can Foreigners Buy Property Without Residency?
Yes. Costa Rica generally allows foreigners to own titled real estate without first obtaining residency.
You do not normally need:
Costa Rican citizenship
Permanent residency
Temporary residency
simply to purchase titled property.
This makes Costa Rica an attractive option for international buyers who want to purchase a home, vacation property or investment property before becoming residents.
Buying Property Does Not Automatically Give You Residency
It is important to understand that property ownership and immigration status are two separate matters.
Purchasing a property does not automatically grant you residency or the right to live permanently in Costa Rica.
If residency is one of your goals, you should evaluate the available immigration categories separately and consider your plans before structuring your investment.
Can Buying Property Help You Qualify for Investor Residency?
Yes. Costa Rica has an Investor Residency category for qualifying investments.
Under the current applicable rules, the minimum qualifying investment for this category is US$150,000. Real estate is one of the types of investment that may qualify, subject to the applicable requirements and documentation.
This means that a foreign buyer who is considering purchasing property for both personal or investment purposes and future residency should consider the residency requirements before completing the purchase.
It is important to verify the current immigration requirements at the time of application, since laws, regulations and administrative requirements can change.
Do You Need to Be a Resident to Complete a Property Purchase?
Not necessarily.
Foreign buyers can generally complete a real estate transaction without becoming residents first.
However, buyers should be prepared to provide appropriate identification and documentation. Attorneys, banks and escrow providers may also request information about the buyer and the source of funds as part of Costa Rica’s legal and anti-money-laundering requirements.
Can You Buy Property Through a Costa Rican Corporation?
Yes, a property can sometimes be purchased through a Costa Rican corporation.
However, forming or using a corporation is not automatically the best option for every buyer.
The appropriate ownership structure depends on factors such as the buyer’s circumstances, estate planning, tax considerations, financing and intended use of the property.
For this reason, the ownership structure should be evaluated with appropriate legal and tax advice before purchasing.
What About Beachfront Property?
Foreign ownership of titled property is generally possible, but properties located within Costa Rica’s Maritime-Terrestrial Zone are subject to special rules.
A property advertised as “beachfront” should therefore be carefully reviewed before assuming that it can be purchased and owned in the same way as ordinary titled property.
Legal due diligence is particularly important for coastal properties.
Should You Become a Resident Before Buying?
There is no general requirement to become a resident before purchasing property in Costa Rica.
For many buyers, the decision about when or whether to pursue residency depends on their personal plans, how much time they intend to spend in Costa Rica, their investment objectives and their immigration goals.
The important thing is to understand that buying property and obtaining residency are separate processes.
Final Thoughts
You do not generally need Costa Rican residency to buy property in Costa Rica.
However, if residency is part of your long-term plan, it is wise to consider that objective before purchasing. This allows you to determine whether the property, investment amount and ownership structure are appropriate for your goals.
